1. Overview
Renterval LLC (operating as University Rec Rentals) respects the intellectual property rights of others and expects users of the University Rec Rentals platform to do the same. This policy describes how we handle notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
If you believe that material you own or material whose copyright you are authorized to enforce has been copied or made available on University Rec Rentals in a way that constitutes copyright infringement, you may submit a notice as set out in §3 below. We will respond promptly, and we may remove or disable access to allegedly infringing material in accordance with the DMCA.
2. Repeat-Infringer Policy
University Rec Rentals may take appropriate action against users who repeatedly infringe the intellectual property rights of others.
Depending on the circumstances, actions may include removing or restricting access to allegedly infringing content, issuing warnings, suspending access, or terminating an account.
We may also consider relevant evidence, the circumstances of the complaint, and applicable law when determining the appropriate response.
3. How to Submit a DMCA Notice
If you are a copyright owner or an authorized representative and believe content available through University Rec Rentals infringes your copyright, you may submit a written DMCA notice to:
Email: info@universityrecrentals.com
Subject: DMCA Copyright Infringement Notice
Please provide sufficient information for us to identify the copyrighted work, the allegedly infringing material, and the basis for your claim.
A complete notice helps us review your complaint and take appropriate action.
4. Required Elements of a Valid Notice
To be effective under § 512(c)(3), your notice must include all of the following:
- Identification of the copyrighted work you believe has been infringed, including enough information for us to identify the work.
- Identification of the allegedly infringing material and information that allows us to locate the material.
- Your contact information, including your name, mailing address, telephone number, and email address.
- A statement of good faith confirming that you believe the disputed use is not authorized by the copyright owner, its agent, or applicable law.
- A statement of accuracy confirming that the information provided in your notice is accurate.
- A statement of authority confirming, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
Providing complete and accurate information helps us process your notice efficiently.
5. Counter-Notification
If material you uploaded was removed or disabled under a DMCA notice and you believe the removal was the result of a mistake or misidentification, you may file a counter-notification under § 512(g). Send your counter-notification to the Designated Agent (§7) with all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, the district in which University Rec Rentals is located), and that you will accept service of process from the person who provided the original DMCA notice or that person's agent.
Upon receipt of a valid counter-notification, University Rec Rentals will provide a copy to the original complainant and inform them that we will replace the removed material or cease disabling access in 10 business days unless they file a court action seeking a restraining order against the user. University Rec Rentals may, in its discretion, replace the material or cease disabling access between 10 and 14 business days following receipt of the counter-notification.
6. Misrepresentations
Under § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for any damages including costs and attorneys' fees incurred by the alleged infringer, the copyright owner, the copyright owner's licensee, or University Rec Rentals as a service provider. Do not file a notice or counter-notification unless you have a good-faith basis to do so.
